PURPOSE

The purpose of this assignment is to develop learners' ability to discuss the validity of a contract under Malaysian law and to evaluate the implied terms under the Sale of Goods Act 1957.

REQUIREMENT

Discuss the meaning and elements of a valid contract under the Contracts Act 1950. Evaluate the implied terms provided by the Sale of Goods Act 1957. Recommend the amendments that need to be done to Malaysian law related to these implied terms.

1. Introduction on the meaning of the contract and all of its elements. (Identify ALL the eight elements of a valid contract and able to refer to relevant provisions of the Contract Act 1950)

2. Explanation on the meaning of contract of sale of goods, conditions and warranties. (Clear explanation on the meaning of contract of sale of goods, conditions and warranties and able to give example for all the terms.)

3. Evaluation on theimplied terms under the Sale of Goods Act 1957. (Evaluate THREE implied terms in detail and provide relevant section(s) and example for each implied term.)

4. Recommendation for amendment of Malaysian law related to the above implied terms. (Three practical and well-justified recommendations were given. Each recommendation is related to each term.)
