Question 1 (10 marks)
Dave is a single parent with three kids. While off work with a broken ankle, his sister, Lily takes some time of work to help out with his kids and get something doe around the house. Lily's boss, Grant, is not very please by this. Lilly is a graduate lawyer and he thinks that if she really wants a promotion she should be putting long hours at the office and taking time off is simply not an option. When it comes time for promotion, Lily does not get promoted, but instead her much less experienced male colleague is promoted. When Lily asks why, Grant tell she frankly 'Look it is nothing personal but clearly you care more about family or whatever. This is obviously what it will be like when you have kids. If you are not willing to put the hours in maybe you should consider a different profession.' She is even more upset because she overheard Grant at lunch telling another partner 'This whole Lily thing should send a clear message to the females in this office. We are not going to pick up their slack.'
Lily is very upset and has come to you for advice. She would like to know if Grant can say this to her and deny her a promotion on this basis. (USE AUSTRALIA LAW approach IRAC issue, rule, application, conclusion)
