Question 1 (DO NOT USE ILAC) (8 Marks) Johann and Helga Gunter were born in Augsburg, Germany and both only have a basic understanding of English. They are in their early 80s. They immigrated to Brisbane in 2019 as they wanted to be close to their son who has lived here with his Australian wife for the last ten years whilst working as an engineer. They have purchased an old Queenslander in Windsor, a suburb of Brisbane and they wish to have a new roof erected because the current roof is rusty and leaks during storms. Their son Wolfgang recommends Brisbane Queenslander Repairs Pty Ltd which has undertaken some work for him in the past. Matthew, an experienced tradesman, is the sole director and shareholder of Brisbane Queenslander Repairs Pty Ltd. When Johann and Helga telephone Matthew to arrange the work, Matthew notices that Johann and Helga speak little English and are new to Australia. Matthew, who has had difficulty in finding customers in recent months, believes that the contract with Johann and Helga could be a good earner for his firm. He asks Johann and Helga to sign a contract to undertake $4000 worth of work to install a new roof, twice what he ordinarily charges customers. No explanation is provided by Matthew as to the cost except that the couple will be 'getting a great bargain'. Johann and Helga quickly sign the contract with Brisbane Queenslander Repairs Pty Ltd for the repair work. Advise Johann and Helga if they can set aside the contract with Brisbane Queenslander Repairs Pty Ltd in accordance with the Australian Consumer Law 2010 (Cth) (ACL) (and relevant case law). (8 marks)
