Question 1 [Total 33 marks] An advertisement appeared in the Sunday Post on 24 September 2019 that stated: For Sale Hitachu Food Steamer Limited Stock - First come first served Contact: Ms. Mary Jones Mobile: 1234 4321 Jane called Mary by phone on 25 September 2019 and said she wanted to buy one Hitachu Food Steamer. Jane asked Mary whether the steamer that she is selling is the latest 2019 model, the price and the colour it comes in. Mary told Jane that it is the latest model (HC3000) and it comes in both red and white - at the price of $600 each. Jane ordered one red steamer. She was told to make a direct bank transfer to Mary's account by 28 September 2018 and the product will be delivered on 30 September 2019. Later that day, Peter also called Mary with the view to buy four Hitachu steamer. Peter thought it was too expensive at the time and he wanted to check the price at another shop before making the purchase, so he did not place an order on Monday. On Tuesday 26 September 2019, Peter decided to buy the steamer from Mary. He called her to negotiate the price, but she missed his call and he left a voicemail message that said, "he would like to buy four white Hitachu food steamer from Mary at the price of $550 each and if he does not hear from her by 28 September, he assumes Mary is willing to sell it at $550 each". At 7:00 am, 29 September 2019, Mary heard the voicemail message from Peter and she tried to call him but without success. She sent him a message by SMS and informed him that she had sold all the food steamer. Similarly, Mary left a voicemail message on Jane's phone and informed her of the same. Peter thought Mary was fine with the arrangement and he now insist in the delivery of the four steamer. As to Jane, she had already made the bank transfer to Mary on 27 September 2019.
