$40.$ When a tenant wants to transter his or her rights to leased property by assigning a lease or subleasing a leased premises, the tenant:

$$ Is released from the obligation to pay the rent associated with the leased premises in the event the assignee or sublessee defaults $($fails to pay rent$).$

$$ Must typlcally obtain the prior written consent of the landlord who owns the leased premises.

$$ May only do so If the tenant has a periodic tenancy.

$$ Has the legal rignt to sublease property by operation of law, which overrides the terms of the lease.
