4.1 Teejay Collins is employed as Sergeant in the Namibian Defence Force. While drunk at a local tavern, he gets into a bar fight with three equally drunken teenagers. After being hit by a bottle of beer, he takes out his service gun-an AK 47 and shoots two of them on their right legs. He is immediately subdued by other tavern revellers and disarmed. He is subsequently charged with attempted murder. However, his victims also want to institute a civil lawsuit against him. They do not only want to sue him personally but also the Ministry of Defence. You work for the legal department of the Ministry of Defence as an in-house lawyer. How are you going to advise your ministry in this regard? (9 marks)
