Question No. 02: In 1956, the very first constitution of Pakistan was passed in which one of the clauses clearly affirmed that no law repugnant to the islamic injunctions would be enacted and that all the existing laws, if and when found in contradiction to the islamic injunctions, would be amended accordingly. Therefore, when the Muslim Family Law Ordinance 1961 was passed, it drew much criticism from various factions all over the country. These factions were of the view that MFLO 1961 is not a comprehensive set of code to follow marriage (polygamy), divorce and dowry matters but just a compilation of few amendments in English law that usually required solutions from various sources of jurisprudence in settling the disputes.
