They used it anyway as they, and others, often do. There are some steps with a loose hand railing. John was using it when it gave way and he tumbled down the steps suffering a head injury that may leave him mentally impaired. John sues the management company and the apartment owners who says they had no idea the path was being improperly used and no idea that the hand railing was loose.
