Case Study

State Senator Mitre was driving to her vacation home in the mountains over a holiday weekend. Although she was planning to relax for most of the weekend, she had agreed to give a speech at a local charity to help raise awareness of illiteracy. The roads were snow-packed and slick. Senator Mitre was driving too fast for the conditions. She slid off the road, barreled over the median, and crashed into oncoming traffic. Harry, the driver of the other vehicle, was severely injured. Harry's attorney files a claim for negligence against Senator Mitre.

The Federal Tort Claims Act applies in this case because it limits liability of the government for any injuries arising out of a federal employee's operation of a motor vehicle.
