Shantia was employed with Island Packers in New Providence as Quality Control Supervisor. Shantia had a substantial disability that necessitated the use of a special wheelchair for her to get around the factory and warehouse areas. Shantia was a good employee which was evidenced by her excellent performance appraisals for the last four years.
Island Packers was known as an employer that valued its reputation as a progressive employer. A decision was made to expand its operation to the island of Exuma opening a new factory. Shantia applied for the position of Supervisor as it would mean a raise in salary and benefits.
Shantia interviewed for the position and her manager recommended her for the position.. She was shortlisted but not offered the position. Island Packers maintained that Shantia would be “too high risk”
Shantia sued claiming discrimination because of her disability.
