Fall Outfitters, a Georgia business, transmits electronic ads to thousands of e-mail addresses, including gmail subscribers. In response to complaints, gmail blocked all e-mails from Fall Outfitters. Gmail also gathered all of Fall Outfitters' e-mail messages together and returned them to Fall Outfitters in an "e-mail bomb" that brought down the computer system of Fall Outfitters' ISP. Fall Outfitters sued Gmail, claiming that is e-mail messages were protected speech under the 1st Amendment. How would you decide the case? What legal reasoning would you use to decide the case?
