Don't Give The hole NIKE THE RIGHT DON'T BUY NIKE S TO LIE "RIGHT" TO LIE TELL THE TRUTI JUSTD Exhibit 13-6 When making public ap- pearances, Nike chairman Phil Knight and other executives frequently defend labor practices and policies in the Asian factories where the company's shoes are made. In the late 1990s, a protester filed a lawsuit against Nike alleging that the company's public assertions about working conditions constituted false advertising. Attorneys for Nike countered that statements made by executives are part of a public policy debate and therefore are pro- tected by the First Amendment. After the California Supreme Court ruled against Nike, the company appealed. In 2003, the U.S. Supreme Court heard the case as protesters gathered out- side.
