review last case before continuing with this case
Smith, who had harbored personal goals of someday being elected sheriff, now faced a personal and professional dilemma. Apple was a well-respected, highly influential, member of Candyland. However, convinced that something was very much amiss in Apple's actions, Smith contemplated what, if anything, he should do. Smith went home to his family for the weekend with serious concerns about his own future and that of his family as he considered his next
step.
last case i said A)Should Mr. Apple be fired? Why or why not?
- He may have broken the law with some of his activities, in addition to being improper. Mr. Smith should inform the authorities if he has proof that Mr. Apple is engaging in criminal activities. Even without specific proof, Mr. Smith should still speak with Mr. Apple about his worries and offer him a chance to defend his behavior. Mr. Smith should think about leaving the department in protest if Mr. Apple is unable to give a sufficient answer.
- Mr.
- Mr. Apple has to be fired. First off, it's very questionable that he asked department employees to give him a percentage of their bonuses for an "off the books" emergency fund. The utilization of this fund may not be for the benefit of department members but rather for personal gain. Secondly Concern is also raised by Mr. Apple's appointment of Kit Kat, his daughter, as his personal assistant at a salary that looks to be substantially greater than her real job responsibilities merit. Mr. Apple could be using department funding for his own advantage. Last but not least, it is concerning that Mr. Apple appears to be visiting the Chocolate Factory for personal rather than business-related reasons.
B)Identify the primary ethical dilemma and any derivative ethical dilemmas that need to be resolved.
- Mr. Smith's main moral conundrum is whether or not to inform the authorities about Mr. Apple's behavior. Mr. Smith may be endangering his job by raising his concerns if he does not have proof that Mr. Apple is involved in criminal activities. However, Mr. Smith has a responsibility to inform authorities if Mr. Apple is engaging in criminal activities. Derivative ethical conundrums also need to be handled in a number of ways. These decisions involve whether or not to speak with Mr. Apple about his issues and whether or not to quit the department in displeasure. Mr. Apple can become hostile against Mr. Smith if he decides to approach him about his worries, endangering the department leadership. However, if he does not confront Mr. Apple, he may be complicit in Mr. Apple's illegal activity.
- Mr. Smith runs the danger of ruining his career if he decides to quit the department in protest. But if he doesn't step down, he could be involved in Mr. Apple's criminal activities. It's challenging to decide whether or not to report Mr. Apple's behavior to the police. Mr. Smith needs to weigh each option's benefits and drawbacks before choosing one.
C)Imagine you are Mr. Smith. Prepare two distinct alternative courses of action available to you that could address the primary and derivative ethical dilemmas.
- Mr. Smith will be resolving the main moral conundrum if he chooses to inform the police about Mr. Apple's behavior. However, Mr. Apple could retaliate against Mr. Smith if this course of action is taken. If Mr. Apple chooses to take this course, Mr. Smith may be demoted, dismissed, or subjected to other sanctions.
- If Mr. Smith chooses to confront Mr. Apple about his worries, he will be deciding whether to engage in a derived ethical conflict. The underlying moral conundrum of whether or not to disclose Mr. Apple's behavior to the police won't be resolved by this course of action. After confronting Mr. Apple, Mr. Smith will still have to determine whether or not to report his activities to the police.
D)Compare and contrast the two alternatives, including choosing the best option, with appropriate justification based on appropriate decision criteria.
- The wisest course of action for Mr. Smith is to inform the authorities about Mr. Apple's misdeeds. This choice resolves the main moral conundrum and may deter Mr. Apple from carrying out unlawful action. It might also result in Mr. Apple taking action against Mr. Smith in retaliation, but Mr. Smith should be prepared to face this risk.
- The best course of action is to report Mr. Apple's behavior to the police since it could deter him from carrying out criminal activity. Mr. Smith has a responsibility to report illegal activities; otherwise, he may be held accountable for Mr. Apple's actions. Additionally, by alerting the authorities to Mr. Apple's behavior, other department employees could be shielded from being forced to refund bribes to Mr. Apple.
- If Mr. Smith reports Mr. Apple's activities to the police, there is a chance that Mr. Apple will take action against him. Mr. Apple may attempt to harm Mr. Smith's reputation or work to get him dismissed from the organization. But Mr. Smith should be ready to accept this danger because it is the right thing to do. Furthermore, Mr. Smith can be implicated in Mr. Apple's crimes if he fails to disclose Mr. Apple's misdeeds.
- Mr. Smith's alternative choice is to speak with Mr. Apple and express his worries. The basic ethical conundrum of whether to report Mr. Apple's activities to the authorities would not be addressed by this choice, just the subsidiary ethical conundrum of whether to face Mr. Apple. Furthermore, Mr. Smith could run the risk of harm if he speaks up to Mr. Apple about his worries since Mr. Apple might turn on him.
- The primary moral dilemma of whether or not to report Mr. Apple's actions to the authorities is ignored if Mr. Apple is confronted about his concerns. Furthermore, Mr. Smith could suffer consequences if he tells Mr. Apple about his concerns because the latter might turn against him.
E) Would be examining the situation from a consequentialist vs a deontological perspective alter your conclusion? Explain.
No, from a consequentialist vs. deontological standpoint, nothing would change. If anything, the fact that other department employees are also being impacted would make it more obvious that action has to be taken to address the matter. Deontologically speaking, it would be more obvious that something has to be done about the circumstance given that it affects more than simply John Smith and other department employees.
3 weeks later.
Having reached what had become an agonizing decision over several weeks, Smith reported for
work on Monday morning with a heavy heart. Relying on his years as a detective, he decided to
continue exploring the actions of his boss. Smith felt apprehensive, and rightfully so, that asking
questions about Apple could alert the sheriff to his concerns. Smith wanted to chat with Charles
and Bob however he felt they could never betray their cousin.
As such, Smith turned to Frank Fruitloops, the department's fleet manager and, most importantly,
a colleague Smith trusted. Unfortunately, when Smith spoke with Fruitloops confidentially,
Fruitloops confided that while he too was concerned about Apple's actions, he was not only
worried about his job, but even expressed concerns about his safety! While a local hero, Apple
was also famous for a terrible temper.
As a result, Fruitloops was initially, and understandably, reluctant to be forthcoming with regard
to the information Smith was seeking. Fortunately, after several offsite meetings, Smith was able
to get Fruitloops to open up. Fruitloops shared the following:
Firstly, Fruitloops discovered that Kit Kat was being severely bullied at school. As such,
Apples negotiated with the school to have her serve a co-op semester with the police
department.
Secondly, Fruitloops also confirmed Apple had also given him a number of bonuses, and
each time he had demanded at least some, and sometimes even all, of the money back to
add to the department's charity fund.
His worst fears realized, Smith concluded that regardless of the risks involved he needed to
report corruption on the part of a local official to an outside law enforcement agency. Although
he had made up his mind to report Apple's actions, he continued to consider the potential
implications for his own future and became conflicted. Afterall, snitches rarely get promoted.
Before making any life altering decisions, Smith decided to seek tangible evidence before
pursuing the matter further. There were too many lives at stake!
With Fruitloops' help, Smith was able to recruit Fruitloops' assistant, Yolanda Yogurt, who had
confided in Fruitloops that she had just had $3,000 deposited to her bank account as her first
bonus, with a demand by Apple to return S1,000 of the money to him in cash. The serial numbers
of the cash to be returned to Apple were recorded by Smith and Yogurt complied with Apple's
demand. Apple had urged Yogurt to act quickly, because he was scheduled to leave for another
conference at the Chocolate Factory on Thursday, just two days away. Yogurt, Fruitloops, and
Smith went home that evening waiting for the next gum drop to "drop"
On Wednesday morning, Smith learns from Bob and Charles that Apple has a terrible gambling
addiction. Smith could not ask any further questions without causing Bob and Charles to suspect
his motives. Smith shares this news with Fruitloops and the two are convinced Apples is funding
his gambling debts with the department's "charity fund".
On Thursday morning, the following events transpire:
0600: Smith gets a call from the informant. The money had been traced to a bank account
in Geneva. A meeting is arranged for 0630 with the informant, Smith and Fruitloops for
further details.
0605: Smith calls Fruitloops while driving to the meeting location. Fruitloops is no longer
able to make it the meeting and entrusts Smith to gather all the information from the
informant.
0610: Smith meets with the informant, who relays that the bank account in Geneva is
being used to fund Mrs. Apple's medical bills for a rare sugar related disease. The
procedure is only performed in Geneva, therefore the costs are astronomical. The
informant hands Smith all the documentation that confirms Mr. Apple using the
department's charity fund to pay for Mrs. Apples' procedures.
Smith is again faced with a personal and professional dilemma:
Apple is a well respected, highly influential, member of Candyland, who has
dedicated his life to the community. Apple has saved countless lives from harm and
countless jobs due to his recent refinements to the law enforcement agency. Many of
the new recruits credit Mr. Apple for inspiring them to pursue a career in the police
department rather than hustling on the streets of Candyland selling unrefined sugars.
Mr. Apple has been credited for reducing crime levels by 30% since taking over as
elected sheriff.
Mrs. Apple's situation is extremely delicate. The expensive procedure gives her a
90% chance of survival however she needs 5 more doses. Smith is also acutely aware
that she would not mentally survive the devastating news of Mr. Apple's fall from
grace.
Candyland has zero tolerance for corruption. The new policies were designed and
enforced by Mr. Apple himself.
