Both The Roxy and Balta Ltd$.$ have clear signage that indicates which parking is available for The Roxys clients and which parking is available for Balta Ltd$.$s clients.Unlike the previous tenant, Balta Ltd$.$ is operating a dance studio that has similar hours of operation as The Roxy. This has led to many disputes and conflict arising between The Roxy and Balta Ltd$.$ Specifically, Balta Ltd$.$ has complained of the following issues:$1)$ Many of The Roxys clients are parking in the Baltas parking spots. Often leaving their vehicle parked overnight. $2)$ The loud music from The Roxy is impeding the use and enjoyment of the dance studio as the music is so loud that it overpowers the dance studios music. $3)$ The drunk patrons of the Roxy make Baltas customers uncomfortable as they occasionally linger outside the dance studio making inappropriate comments to the dance studio customers.The Roxy has stated that they cannot do anything about the parking or the lingering customers as they cannot control what their customers do after they leave The Roxy. Peter decided to retaliate against Balta by purposely causing his outdoor water line to leak water throughout the night a few weeks ago. The effect of this was that the water flowed over the parking lot into Baltas parking lot. The cold temperatures led to the water freezing and creating a very slippery surface all over the parking lot and sidewalk.Peter paid the local snow removal company, XYZ Snow Removal Inc. $($XYZ$)$to come to his property early the next morning to salt, sand and remove the ice from his parking lot. He also paid extra money to XYZ for them to not remove or provide services to the Balta parking lot for several days. XYZ simply advised Balta that XYZ was too busy to attend to their property. XYZ had a service agreement with Balta and in effect have breached the agreement by not attending at the property on a timely basis. XYZ knew that all other snow removal companies were fully booked so that no one would be able to provide services to Baltas property.Balta had several customers attend the property and as a result of the icy surface, several cars were damaged in accidents.Balta could have applied gravel and salt to the sidewalk outside of their business entrance but decided not too because the owner was busy and none of the employees wanted to go outside and apply the salt and gravel to the sidewalk surfaces. As a result, in additional to the car accidents several customers have slipped and fallen on the sidewalk.
