Question:
Sandy and Brian Scott contracted with Kitchen Renovations (Based in CA) for the complete upgrade of the kitchen of their beach house. Sandy wanted certain features in the kitchen, including a JennAir grill, a built-in sub-zero refrigerator, and, most important, Corian countertops. Kitchen had two months to complete the contract. While purchasing the materials for the job, Kitchen found a much cheaper substitute for the Corian that was undetectable to anyone but an expert. The product was called "Korrien." Kitchen installed the Korrien product and finished the job on time. The Scotts seem happy with the end result. After about one month, Sandy noticed that the countertops were fading and chipping. She had her husband check out the work, and they discovered that Kitchen had not used Corian, but another substandard product. The Scotts want to sue Kitchen for breach of contract.
