Tom is a sole trader who owns a convenience store. Usually, his store is well-lit by fluorescent lights. Unfortunately, due to construction works on a new office tower next door, power needs to be cut to his store for 4 hours on a Saturday morning. Tom is informed of the possible cut to the electricity supply to his store two weeks in advance. Luckily, Tom owns two petrol power generators to power the refrigerators where frozen meals are kept and displayed. Unfortunately, he does not own enough power generators to power the lights but does not believe it would be an issue as the power outage would only occur during the day. Unfortunately, the power generators are insufficient to power the refrigerators on Saturday morning when power is lost. Due to the extreme heat, the ice in the refrigerators melts, and unbeknown to Tom, water leaks and puddles on the floor. Although the floor is visible, due to the fact that the lights were not powered, it was not possible to clearly see the puddle on the floor. Mrs Brown is a customer who trips on the floor, breaks her leg and is hospitalised. She wishes to sue Tom for Negligence.
