Sinan John, a sixty$-$three year old man, has worked for Books & Brew, the coffee shop located on the center of the main library of Hamilton State University $($HSU$)$ for more than $15$ years. A retired HSU librarian, Sinan began working for the coffee shop when it was owned and operated exclusively by HSU. In $2018,$ HSU entered into an agreement with a national retail coffee chain, Books & Brew, $($B & B$),$ pursuant to which B & B would lease the business from HSU and operate the campus coffee shop.

According to the terms of the agreement, the coffeeshop remained in its location in the main library on campus and relied on HSU$$s provision of utilities and maintenance. B & B handled their own business records $($inventory$,$ orders, equipment$)$ and set its own salaries for employees, but relied on HSU for issuing payroll checks and withholdings. Coffeeshop employees continued to enjoy health insurance benefits provided by HSU. Coffeeshop employees could be hired and fired at the discretion of B & B$.$ Pursuant to the $2018$ agreement, some new employees were brought in from B & B$$s other shops but B & B retained many of the employees originally hired by HSU. In the summer of $2022,$ Sinan was terminated. He believed the basis of his termination was his age which is a violation of federal law.

Analyze these facts under the integrated enterprise test set forth in ELHRP. Discuss each of these elements and determine whether you think Sinan will be able to maintain an action against HSU and B & B for wrongful termination. Please note, consistent with your readings in Chapter $2,$ your answer should focus on the relationship between HSU and B & B and whether Sinan could sue both of them.
