SUBJECT: LABOUR RELATIONS

Purpose: The Virtual Bargaining Negotiation Simulation Activity (40%) is a major component of this course. It is your opportunity to participate in a labor contract negotiation simulation, putting theory into practice!

Part 2 Instructions: Appendix C from the previous edition of our textbook provides a collective agreement for Diamond Casino that will be used as the basis for this activity. A PDF copy of this collective agreement is available on Brightspace as many of you probably have the current edition of our textbook!

IMPORTANT: Choose a maximum of up to 8 (eight) articles where you would like to propose changes and up to 2 (two) new articles you would like to add for a maximum of up to 10 (ten) proposals/demands in total. You must develop your initial bargaining proposals AS A BARGAINING TEAM do not discuss your strategy with anyone else! Bargaining Teams will be confirmed on Thursday, June 17 each Bargaining Team will have your own virtual caucus room discussion group where you can connect for a confidential discussion on strategy or you may feel free to exchange contact information and connect outside of Brightspace if you prefer it is up to you how to choose to connect with your Bargaining Team! In addition to your initial bargaining proposals/demands, you will also prepare a short (two-page maximum) confidential explanation of your strategy to be submitted to your instructor, including which demands/proposals are the most important to you and which items you have strategically included to leave yourself some room to negotiate.IMPORTANT: DO NOT SHARE YOUR CONFIDENTIAL STRATEGY DOCUMENT WITH ANYONE ELSE ONLY DISCUSS IT IN YOUR BARGAINING TEAM AND SUBMIT IT TO YOUR INSTRUCTOR! Reminder: The initial bargaining demands/proposals you prepare should follow the order of the collective agreement. Demands/proposals relating to any new terms for the agreement (if any) may be placed at the end of the document. The proposals/demands should be presented in the form of a memo to the other side, and the format is as follows: The [Union or Employer] proposes that the current collective agreement be renewed with the following changes and additions: Article ____ shall be amended to provide that the first Monday in August is a paid holiday. An article shall be added to the collective agreement providing for the distribution of overtime on the following basis: Etc. For each proposal or demand, you also need to explain why you are proposing that change. For example, using the overtime example listed in (2) above and assuming you are representing the union, it might look like this: An article shall be added to the collective agreement providing for the distribution of overtime on the following basis: detailed explanation here of the changes Explanation: The union is requesting this change because the current overtime language is not equitable and is resulting in uneven and unfair access to overtime opportunities for employees. The union believes that the overtime language we are proposing will correct existing issues and result in fewer overtime grievances because the process will be more transparent and equitable. IMPORTANT: Do not confuse your explanation with your separate CONFIDENTIAL strategy document that you will submit only to your instructor! DO NOT INCLUDE ANY STRATEGY DETAILS IN YOUR INITIAL BARGAINING PROPOSALS SUBMISSION YOU WILL BE EXCHANGING THIS DOCUMENT WITH ANOTHER BARGAINING TEAM NEXT WEEK AND YOU DO NOT WANT TO GIVE ANY STRATEGIC DETAILS AWAY! Please use plain language to explain your proposals/demands you are not required to use contract language but you should be clear with your explanations! IMPORTANT: Remember that it could be considered bargaining in bad faith to try and add new items AFTER you have tabled (presented) your initial bargaining proposals, so be sure to include everything you want to be able to discuss/negotiate in your initial proposals. PLEASE NOTE: in total, you should have two separate documents you are preparing for your initial proposals: Initial proposals or demands that you will submit to your instructor (and eventually exchange with another bargaining team next week!): In the form of a memo as outlined above Lists each proposal/demand (eg what are you proposing should be changed?) Explains each proposal to the other side (eg why are you proposing it should be changed?) Maximum of 8 (eight) articles where you want to propose changes and maximum of 2 (two) new articles, for a maximum of 10 (ten) proposals/demands in total Confidential strategy document to be submitted to your instructor only (NOT TO BE SHARED OR DISCUSSED WITH ANYONE ELSE): Two page maximum A short explanation of your strategy You must identify your most important priorities as well as items that are not as important to you that you may be willing to give up IMPORTANT NOTE: You will submit your two documents (Initial Bargaining Proposals AND Confidential Strategy Document) via the Group Assignment Folder on Brightspace by 11:59 pm on Tuesday, June 22. This Assignment Folder will be visible starting on Thursday, June 17 (when your Bargaining Team groups are confirmed) and only one person from your Bargaining Team needs to submit your documents via Brightspace. Please be sure to include the names and student numbers of ALL Bargaining Team Members when you submit your documents.
