When you meet with a trade contractor or communicate via email, it is often a very informal interaction and it is important that you know that the tradesperson has the intention to enter into the agreement with you as an agreement that is subject to the law.

i.How can you be assured that the tradesperson is aware of their legal obligations with respect to the agreement? (Suggest two actions by the subcontractor that would confirm this)

ii.Why is it important that you obtain this assurance?

a.List the essential elements of any contract (including subcontracts) that must be observed to ensure the agreement is legal.

a.Briefly discuss whether the contract is enforceable at law if any of the above essential elements is omitted.
