A.W&Ws findings highlight certain serious breach of Constitutional or Fundamental duties by the workforce and certain sections of the staff-function employees, for which disciplinary actions have been advised. Which of the duties were breached and why ?

Activa Chemicals is a medium sized manufacturing enterprise, whose promoters are qualified technocrats and also the top management of the organisation. The company pays salary duly on the 30t of the month and there are set of managers who have designated reportees with some having dual functional reporting. The company operates in 3 shifts (of 8 hours each) and manufactures different grades of basic chemical products and has a good customer base and market goodwill. There are over 200 workers and employees in the enterprise, including permanent workforce and contractual labourers. Recently the Company's Board of Directors had appointed an Industrial Law and Strategic Consulting firm, Willow Wind (W\&W) to undertake study of their legal affairs and personnel matters in the wake of some complaints lodged by the shopfloor workers and some employees. There seem to be many things happening in the organization, particularly in their manufacturing unit, which are indicative of serious misgivings amongst a certain section of the workforce and also the junior level employees. W\&W conducted a thorough study at the plant and also at the head office and submitted detailed legal findings to the Board, which has been forwarded to the Production Manager who also has an additional line authority of Personnel \& Law, as designated by the Company Board. The summary of the findings are as mentioned below : i. A section of the plant workforce are very much unhappy and has become 'dissidents', who are primary offenders to violate official policy of plant operation. ii. Some members of the dissident section of the work force, instigated the contractual labourers to go on strike and it is found that this dissident section has affiliation to some political groups who are fostering separatist ideologies in the state. iii. During the Republic Day flag hoisting ceremony, this same group raised anti-national slogans and spoke against the Management of the company in negative lights. They also tried to create unrest and stop production of the plant. iv. Some of the contractual labourers were provoked to cause damage to plant assets and equipments including common utility facilities of the workers' quarters built on the land of the local municipality, which is governed by the state government. v. The Personnel department is found to regularly delay the release of the education allowance for the children of the workers, although applications are cleared by management on time. vi. Some of the plant employees and workers of SC, ST or OBC categories are not regularly given the subsidised canteen coupons on some flimsy grounds, that they are eligible of. vii. The staff function employees are not entitled to over-time payments if they are required to stay after office hours for work, which line function employees are entitied to. viii. Workers' canteen serves food and beverages to permanent workforce all time during the day, whereas contractual labours are served lunch and evening tea and snack only at specified times. 1)Page ix. No specified prayer rooms are provided in the plant premise, for men and women of certain religion to practice their prayers during some designated periods of the year. x. Informal gatherings inside production shop floor in safe and secured regions are not encouraged and not allowed often, even during shift breaks and lunchtime. xi. Except ladies washroom, there is no separate cloakroom (dress change room) for women in the plant premise. Only a single ladies' change-room is available in the admin and staff office building in the plant. xii. During festivals, restrictive holidays are allowed and not all cultural events or celebrations are encouraged by the management
