Q: Chad is a 50 year old supervisor. He learns one day that he is being fired and replaced with Corey, a 31 year old, because it was time for some new blood and new ideas.

A: Based on these facts, Chad has a case for age discrimination under the Age Discrimination in Employment Act because he is a member of the protected group (over 40), is qualified for the position, and was let go for reasons that suggest age discrimination.

Part 1: ABC Corp. hires salespeople based upon a standardized written test, with the highest scoring applicants being hired. Over the past two years, the total pool of applicants consisted of 50% male and 50% female. Based solely on tests scores, 90% of all new hires were female.
