This week the case for the case analysis assignment is a hypothetical. This means that this week you will be presenting your analysis on how the case should be decided. This means that you will need to find a source or sources for the applicable rule. Here is the scenario:

You are in the Chatt State cafeteria, post Covid restrictions. At the next table a couple of students are talking about having taken BUSN 2370 before. They are talking about how they cheated on the research paper assignment. They mentioned that there are several web sites that will sell you a research paper on any topic in the course. This information troubles you - you have never cheated and have never even thought about cheating. Since you are studying ethics in class you decide you need to conduct some research before acting, if you act at all. You decide to review the academic integrity language in the syllabus and the academic integrity language in the student handbook.

This week the case for the case analysis
There are five parts to the assignment. Each part can be as short or as long as you deem necessary, but each part should be at least one paragraph in length DO NOT repeat the descriptions below in your case analysis but do apply the headers from each part to provide me with a roadmap of your case brief. Finally, do not make assumptions about the case that the reader will know or understand. Fully explain to the reader what you mean and what you have interpreted in drafting all parts to the assignment. 1. CASE FACTS (relevantecessary/required to resolve case) Facts can be listed with a short commentary as to why they are relevantecessary or required or facts can be described in a narrative or presented in a bullet point list 2. RULE (legal rule or code that is relevantecessary/required to resolve case) Legal rules are the applicable areas of law that apply to the case. For instance, a slip and fall case would apply the tort rule of law called negligence. Negligence has several parts which you would present in this part of the case brief (i.e. duty, breach, causation in fact, causation in law or proximate cause and harm) 3. ANALYSIS (application of case facts to the legal rule or code to resolve case) Analysis is the process of examining the facts of a case against the legal rule or ethical code to render a decision. For instance, in a negligence action, the first fact to look for in the case is a fact that describes a duty to act on the part of the party who was Negligent. If you cannot find a fact that establishes a duty to act, then there cannot be a successful negligence claim against that person. 4. DECISION (summarize the Court's holding and comment upon the precedential value) What was the Court's holding/outcome of the case? 5. CONCLUSION (your opinion about the case - was it decided in the correct way?) Tell me what you think of the case. Was it decided correctly in your opinion? Incorrectly? Is the decision a good precedent for other judges to follow
