Today, you will be separated into groups - the company group (which contains Bobby Boss, John Demanding, and the Company Lawyer), the union group (which contains Wally Worker, Sidney Steward, and the Union Lawyer) and the arbitrators. You will work together to prepare for the simulated Arbitration session that will take place next week.

Some things to note:

The company and union groups have information which is not available to the other groups. They may or may not present it. It is the lawyer's responsibility to make sure that all of the relevant information is presented -- either under the original examination or under cross examination.

Arbitrators control the meeting. There is a standard procedure (see Chapter 11) however if the arbitrator deems it necessary they can change it.

Arbitrators are allowed to ask questions of witnesses when they are on the stand.

Arbitrators can make decisions that are outside of the two positions at hand ... eg. order training for any party, disallow evidence, etc. but only if a good justification is given in their ruling.
