Question:
Tomas read the advertisement and arrived at Electro-mart on Sunday afternoon and told them that he wanted to buy the Marvel watch for $499.95. Electro-mart staff told Tomas that they were no longer selling Marvel watches. (Electro-mart had plenty of Marvel watches available, but had decided not to sell them for so cheap.) Electro-mart staff told Tomas that he should buy the Easy-Watch, which had improved features, for only $429.99. Tomas bought the Easy-Watch for $429.99. Unfortunately, after he brought it home, he realized that the improved features on the Easy-Watch were useless for him. Tomas had the receipt and tried to return the Easy-Watch but was told by Electro-mart staff that "all sales were final". Nobody at Electro-mart had told him that "all sales were final" before; nor did the store have a published return policy.
What remedy in contract law, if any, does Tomas have against Electro-mart or its staff? Explain in full, using the terminology used in ontario law . Consider contract law.
