Use the template we discussed in class to prepare your factual analysis of the assigned case. Case Name: PI v Def. Issue: Area of law and remedy sought. Reasoning: discuss what the plaintiff must argue and any possible defences. State what you think may be the outcome. Risk Reduction: one suggestion for each of the parties. Scenario: On November 1st Winnie Lang and 3 female friends decided to attend an indoor concert featuring Jim Russell. The concert was put on by Have Fun Ltd., in a venue that they owned. Winnie and her friends all wore a dress, socks and leather boots. Their legs were otherwise bare below their knees. The performance lived up to the gir's expectations until Mr. Russell's grand finale, in what seemed to be an attempt to replicate a stunt performed in concert by the late Jimi Hendrix. As Jimi Hendrix famously did on stage at the end of a set. Mr. Russell laid his guitar on the floor, poured a liquid on it from a water bottle and ignited it. There was, by the gir's account, a "huge flame:" Mr. Russell appeared to panic, he dropped the bottle and appeared to kick it away from himself. The flaming liquid extended to where Winnie and her friends were standing and, while ablaze, splashed onto Winnie's legs. Whlle on fire she tried to escape the venue and was stopped by a security guard who. with assistance from others, smothered the flames. With help. she made her way outside. where she tried to cool the burns with water from a puddle She was transponted to a hospital by ambulance. Her friends were not injured. Winnie suffered severe burns to both legs from the sock line up to the lower thighs. She was admitted to the burn ward, where she was given a "burn shower" to cleanse her wounds. The resulting pain was excruciating. After her burns "declared themselves" she underwent two skin grafts, both under general anaesthetic. Recovery at the donor sites was extremely painful. Her mother stayed at the hospital "24/7" in the first week and then daily until she was discharged. After two weeks of treatment, she was discharged to home in the care of her mother. Her pain was managed with medication. Reasoning: Risk Reduction
