Question 1 (15 points) Saved Listen The facts of the case are as follows: Silvers was driving from his home in Victoria on his way to a golf tournament in Kamloops. He encountered some car trouble when he got to Hope, so he stopped at a garage (Hank's Auto Repairs) to have the problem attended to. Silvers had a very valuable set of golf clubs in the trunk of his car. Hank's mechanic told Silvers the repair job would take about a couple of hours and suggested he go into town and have a bite to eat in the meantime. Silvers, of course, had to leave the keys with the garage: he left his car in front of the garage office. About an hour later, Hank's mechanic temporarily removed the car to the far end of the garage's parking lot. When doing this, he left the key in the ignition and the door unlocked, intending to bring the car several minutes later into the garage for the repairs to begin. However, he got interrupted and the car was left for about half an hour in that spot before being repaired. The repairs were done, Silvers returned and paid for the job, but when he opened his trunk to put some packages in there, he found his golf clubs were gone. Silvers demanded that Hank's Auto Repairs reimburse him for his lost clubs. Hank's Auto pointed to a notice in the office that said: "Not responsible for lost or stolen property in customers' vehicles," which Silvers acknowledges he saw when he arranged for the car to be repaired. Silvers called the police, and they advised him that there had been a rash of thefts from cars in the Hope area over the last few months.
