Question:
Using the story below discuss possible claims your firm might bring on behalf of the client and identify possible defendants (think about all possible defendants). You should discuss the elements of the potential claims in conjunction with your facts. For example, if negligence is a potential claim, then you should mention all four elements of negligence and decide whether each element is met by discussing the facts of the case.
Scenario: I interviewed my friend, Joe, who encountered a hazard while living in an apartment complex. The hazard was an exposed electrical wire. Joe noticed that one of the wires in the ceiling of his bedroom was exposed and could easily be touched. He reported it to the landlord, but the landlord did not take any action. Joe was worried that the exposed wire could cause an electrical fire or harm someone and he was concerned for his safety and the safety of his roommates. He eventually took matters into his own hands and used duct tape to cover the exposed wire. Unfortunately, Joe was harmed by this hazard due to him accidentally touching the wire while covering it up and is now in the hospital.
