Bob refuses to accept the golf balls because of the delay, and then sues Titleist for breach of contract. Assuming that there is no additional information about Bobs refusal to accept the balls, how should the Court rule, and why?

He calls the owner, agrees to the sale terms, and informs the owner that he is leaving his house now to come get the car. When he gets to the sellers house he discovers that the car has been sold to someone else. He sues the seller, demanding specific performance on their verbal agreement.
