When talking about the "definition of this category", I'm referring to the question - "How do we legally categorize marijuana in regard to government advertising restrictions?" Should it be treated like alcohol and tobacco (aka standard vices with no health benefits)? Or, because of its medical benefits, prescription drugs? Or, something else..
The rules for advertising alcohol and prescription drugs are very different.
The competing interest would involve, among others: drug companies, the government regarding the health of its citizens and taxes, police, citizens who don't use marijuana (especially children), marijuana dispensaries, and users of marijuana both for medicinal and recreational purposes.
I want you to use the Central Hudson test to discuss how the government should approach marijuana ad regulations. Use the test to try to answer how you think marijuana advertising should be restricted...should it be closer to alcohol, prescription drugs, or a completely new category in itself?
