In direct violation of the BSA, investigators recently discovered somewhat inadvertently that TD Bank was involved in several money laundering schemes during a separate investigation of a Mexican cartel (Nicodemus, A., 2024). The company was subsequently charged with criminal and civil crimes for having moved more than $670 million through the system during these illegal activities (International Compliance Association, n.d.) Effects of Ethical Issues on TD Bank Us regulators ultimately fined TD Bank $3.1 billion as punishment for its crimes (International Compliance Association, n..). Though the scandal is still relatively new, looking at the impacts on similar organizations could act asa bellwether as to how these crimes may further affect TD Bank's corporate performance. For example, during their legal scandal, Wells Fargo's CEO was called to testify in front of Congress and ultimately resigned, a path that may still lie ahead for some TD Bank employees (Wentink, 2024). Officials state that corporate culture lent itself to be an obvious choice for conducting such crimes, with a deprioritization of corporate compliance (international Compliance Association, n.d.). Employees reported often knowing of the illicit conduct, even joking with colleagues about how criminals would exploit this laxity in compliance (Wentink, 2024). Some employees were even complicit in these activities by accepting gift card bribes if they would push through a massive deposit (Nicodemus, A., 2024). Due to criminal activity's pervasive and persistent nature, the employees became apathetic about whistleblowing and seemingly desensitized. The company has previously been caught up in legal troubles, having settled with US authorities over a Ponzi scheme that exceeded $50 million in 2015 (Wentink, 2024). Despite having another massive run-in with the law less than a decade ago, neither set of charges has seemingly diminished TD Bank's perception to the public, Wentink (2024) notes that this illegal behavior has become somewhat expected of financial institutions and that we asa society must not accept or normalize these behaviors. 'OD consultant's role in establishing ethical guidelines and behaviors As an OD consultant, the following would be the initial steps taken to improve TD Bank's ethics and behavi 1, Maintain integrity self-mastery: Before consulting, it would be essential to ensure that the consultant has a well-developed set of integrity-centered values and beliefs communicated at the onset of the relationship (Corn, 2015; International Organization for Group Psychotherapy and Group Processes, n.d.) 2. Remain open-minded: Despite repeated criminal convictions, it is critical for the OD consultant to remain open-minded and not pass judgment (Institute of Organization Development, 2015). Demonstrating respect and empathy for the clients will make them more likely to have transparent and vulnerable conversations. Creating a psychologically safe space may help identify how this culture may have developed and why it has persisted, ensuring that they are sincerely ready to change behavior and co-develop a forward-looking, positive change plan. 3, Develop genuine corporate mission, vision, and values: Challenge leadership to undergo a corporate renaissance by creating a new, sincere mission, vision, and values incorporating ethical practices at all levels. Statements should be pressure tested by workshopping with executives to understand what corporate interventions and tactics support the ethical actions. 4, Optimal change model selection: Selecting an appropriate change model is vital to ensure that establishing an ethical culture is feasible and sustainable for TD Bank. The Engage and Learn model would support change needs in the dynamic and highly competitive banking world while encouraging continuous learning and employee empowerment to solidify the new, ethically committed culture (Worley & Mohrman, 2015). 5, Tangible policy development/revision: Policies support the action of ethical statements. These should include conflicts of interest, pratection of whistleblowers, Well-defined policies, and ramifications of non-compliance on Integrity and ethics are foundational to OD and should guide personal behaviors and professional practices. As is often insidious, OD practitioners must continuously surveil for ethical dilemmas and take proactive steps to eliminate the risks (Corn, 2015).
