A hiring manager comes to you, the HR Associate, with a list of questions that he/she would like to use for their interview to select an office manager. Your task is to review the questions and identify which questions are appropriate and/or inappropriate based on employment legislation.

Here are the questions the hiring manager would like to use:

1. Tell me about a time you were faced with a difficult customer or staff member.  How did you handle the situation?
2. Are you planning to take any other classes or complete any other certification or designation that will assist you in your career growth?
3. Are you legally entitled to work in Canada? 
4. What clubs or social organizations do you belong to?
5. What religious holidays do you celebrate?
6. Are you able to perform the essential functions of this job?
7. With this position, would you require any accommodations?
8. Why did you leave your last position?
9. What year did you graduate high school?
10. What foreign languages can you read, write or speak fluently?

As you review each question, be sure to provide the hiring manager with :

 A) a rationale to support each decision you recommend

B) If you believe that a question is not allowable, you must offer a question that is allowable in its place

Situation B

A supervisor has just approached you to indicate a concern she has with an employee.  The supervisor indicates that the employee is often surfing the internet while at work and fears that not only is this affecting productivity negatively, but is also a violation of the company's rules for internet surfing using a company computer.  The supervisor would like to ask the IT team to investigate how many hours a day are logged to non-work-related activities for that employee and also ask for a list of websites that the employee visits.
