You have prepared the majority of the complaint. Luann and Irene have now asked you to add the specifics of the accident and one count of negligence to the work you have already completed. You will put all of it together in a future module, so you do not need to add the parts you have already completed to this project. Facts given to you in M01: Project still apply. You will prepare this project in a Word document and then upload the Word document as an attached file to submit the project.
- Prepare a facts section of the body of the complaint.
- The subtitle "Facts" should be centered and bold.
- The facts section should have at least six paragraphs.
- The facts should be written in the light most favorable to the plaintiff.
- In other words, you cannot misstate the facts, but you do not need to help the defendant, either.
- Not all of the facts provided to you are necessary or relevant. Focus on the facts that help the reader understand what happened to Irene and support a negligence cause of action.
- Prepare the counts section of the body of the complaint.
- The subtitle "Count I: Negligence" should be centered and bold.
- One paragraph section should describe the duty owed by Sam to Irene.
- One or more paragraphs should describe how Sam breached his duty to Irene. There are multiple different ways Sam breached his duty. Do not forget the biggest and most obvious of the duties (not hitting another car)!
- One or more paragraphs should describe how Irene has been damaged by Sam.
- One paragraph should describe the causal link between the breach and the damages.
