Online purchases are commonly governed by a sales contract between the online merchant and the consumer in the “terms of use” found as a link on the seller’s home page. Often, purchasers are informed that using the site or ordering merchandise constitutes acceptance of the terms and conditions found in the link. Research shows that the overwhelming number of users do not read the “terms of use” and that they order merchandise without any idea of their contract rights and obligations or the rights and obligations of the vendor. Is it ethical for online merchants to utilize this practice even though it may be legal to do so? Explain.
