Twenty-two Argentinians initiated a lawsuit against DaimlerChrysler Aktiengesellschaft (DCAG). In its complaint, the plaintiffs stated that a subsidiary of DCAG, Mercedes-Benz Argentina (MBA), collaborated with Argentinian security forces to kidnap, detain, torture, and kill them and their relatives. Of the 22 plaintiffs, one is a citizen of Chile but a resident of Argentina. The remaining 21 are Argentinian citizens and residents. The plaintiffs either worked at MBA or had relatives who worked there. The plaintiffs alleged that MBA brutally punished them and their relatives because MBA saw them as union agitators. The complaint further alleged that MBA decided to collaborate with the Argentinian security forces as a means of brutalizing the workers. The plaintiffs filed their lawsuit against DCAG in the District Court for the Northern District of California under the Alien Tort Statute (ATS). The plaintiffs selected the United States as a forum for its lawsuit, in part, because DCAG maintained a physical presence (an operational headquarters) in Auburn Hills, California.
