In recent years, the Federal Trade Commission (FTC) has been concerned with patent litigation settlements between brand-name and generic manufacturers in the pharmaceutical industry. A primary focus of the FTC in these cases involves agreements between brandname and generic manufacturers to keep generics off the market in return for often sizeable payments. Use the Five Forces model to explain why brand-name pharmaceutical manufacturers would want to enter into such agreements, and explain why these patent litigation settlements have drawn the attention of the FTC.
