Question:
After dating for over a year, Jack asked Jill to move in with him and gave her a key to his apartment. Shortly after Jill moved in, Jack and Jill got into an argument, and Jill moved out. Jack, however, forgot to get his key back from Jill. When Jack went out of town the following week, Jill called the police and told them that Jack was selling drugs out of his apartment. She explained that she was Jack's girlfriend and that she lived with him. Without obtaining a warrant, the police went to the apartment and asked Jill to let them in. While searching the apartment, the police did not observe any of Jill's personal items, but they found a large quantity of drugs. Jack was charged with dealing drugs. Jack promptly filed a motion to suppress the drugs, arguing that the search of his apartment was illegal because Jill's consent was not valid.
Do you think the judge should grant or deny Jack's motion to suppress the drugs? In other words, was Jill's consent to the search of Jack's apartment valid? Explain the significance of the fact that the police did not observe any personal items belonging to Jill in Jack's apartment.
