Week 5 Assignment - 2 Essay Questions Question 1 - Agency: In your own words, based on the reading and videos this week (no external sources beyond the assigned coursework please), explain the legal concept of Agency and why it is important. In explaining agency, use a case from the textbook as an example to discuss Respondeat Superior (vicarious liability) and Scope of Employment. And finally, comment in a sentence or two how using an independent contractor changes the role of employer/employee in terms of liability (explained in the textbook Part 3 Intro). (10 points) Question 2 - Contracts: In your own words, based on the reading and videos this week (no external sources beyond the textbook please), discuss the requirements for a valid contract; use illustrations for the types of contracts discussed in the textbook. Be sure to discuss if oral contracts are generally legal, the idea of consideration, and using a case from the textbook in Chapter 9 (assigned reading cases only please), why the court ruled a certain way in that case and what would you have done differently had you been the losing party. In a final paragraph, identify 2 or 3 significant provisions of the sample contract discussed in the guest video lecture. I would expect this to be in the 1-2 pages area, but take the space you need to fully complete the assignment. Double spaced, 12 point font, paragraph style.
