Assignment: Assignment 5 (based on class 15) The President of the United States has asked Congress to authorize the use of military force in Xanadu. He has asserted that Xanadu is suspected of secretly developing nuclear weapons and of plotting to assassinate the national leaders of six countries. To bolster the President's case, he presents Congress with more than 500 documents that illustrate both the reliability and credibility of this intelligence. Senator Felicia is not sure how to vote on the President's requests. She would like to see many of the intelligence documents that the President did not show to Congress to determine how believable this intelligence actually is. So, the senator asks that the CIA and Department of Homeland Security produce a host of documents related to intelligence operations concerning Xanadu. All of these requests are denied. Senator Felicia then files a request for production of these documents under the Freedom of Information Act. These requests are denied on the grounds that it would compromise national security to release these documents, even to US Senators. Senator Felicia sues in Federal District Court for the District of Columbia, seeking an order forcing the CIA and DHS to comply with her FOIA request. You are a clerk working for the judge who is assigned to the case. You are asked to prepare an essay on the question of whether the court should grant Felicia's request or should side with the government's agencies. Please write this essay.
