Alex had been eager to host a small gathering in her backyard after having spent the summer months landscaping and building a new deck to create a cozy backyard oasis. Alex invited over Emily, Fiona and Danielle on Friday night at 7:00 for some cocktails and appetizers. With the cool fall weather fast approaching, Alex wanted to invest in an outdoor fire table that would bring warmth to the space. Alex wanted a table that was safe around people, easy to use, and was within her budget. After researching the options for outdoor re tables by perusing online sites, Alex identied that her options included a traditional wood burning pit table or a table that used a ammable liquid like ethanol or propane to maintain a ery flame. The ammable liquid option worried Alex as she had heard about some accidents involving people getting burned. Alex took advantage of a Labour Day sale at Bert's Appliance Warehouse and met with sales associate, Cameron, to discuss her options. Cameron, a recent university graduate, had started his position two weeks earlier and was still in the process of learning information about the products carried at the store. Alex advised Cameron of her required criteria and expressed her concerns about the safety of the fuel bunting tables. Cameron recommended the FlameTopper 2000, manufactured by Hot Tamale Ltd. as an option for a wood burning model, or the HeatSeeker 360, manufactured by Endless Summer Inc. as a fuel burning option. Cameron advised Alex that the HeatSeeker 360 was "much safer than the FlameTopper 2000" because the ame could be more precisely controlled and that it was so easy to use that "a child could do it". Based on Cameron's recommendation, Alex purchased the HeatSeeker 360 and took it home to assemble. Alex noticed that the instructions on the fuel valve did not contain any warning signs and that a slight "hissing" sound could be heard after it was set up, even though the fuel valve was in the "OFF" position. Cameron did not tell Alex that his father was a 50% shareholder of Endless Summer Inc. and that he would receive a bonus commission of $500.00 if a customer purchased an Endless Summer inc. product. As Friday came, the temperature dropped to 12 degrees Celsius and Alex was thought it would be the perfect time to try out the HeatSeeker 360. Alex led her guests to the back patio when they arrived and went back inside to get some appetizers from the oven. While Alex was inside, Emily volunteered to light the HeatSeeker 360, claiming that she knew how as her parents had a similar model at home. Emily retrieved the cannister of ethanol fuel from beneath the table and began to squirt some onto the rocks at the centre of the table which covered the gas burner and provided decorative air. Emily did not check to see if the burner was on or if there was heat coming off the rocks and did not bother to read the manufacturer's instructions, which were sitting nearby, before proceeding. The moment the stream of fuel hit the rocks, it ignited, causing the cannister to become engulfed in ames and creating a reball in Emily's hands. Paniciring, Emily instinctually threw the cannister to her right, which landed in Fiona's lap and caused her clothing to catch re. Fiona suffered severe third degree burns on her thighs, hands and wrists and was immediately rushed to the hospital. The burns caused permanent disgurement to Fiona, a runway model. As a result of the accident, Fiona lost a lucrative international modeling contract with Global Modelling Agency worth $1,000,000.00. Fiona sued Alex, Emily, Cameron, Bert's Appliance Warehouse and Endless Summer Inc., for damages in the amount of 5,000,000.00 alleging negligence, negligent misrepresentation or a negligent failure to warn of the dangers of a product.
