Andre who is migrating from the Island wrote two separate letters to sell his Mazda CRV motor vehicle. One letter offered to sell the vehicle to Bryana for 1.7 million dollars and the other letter offered to sell the same motor vehicle to Collin for the same figure. The letters were issued on Thursday May 26, 2024 and stated that the offer will be open until Tuesday May 31, 2024 at 4.30 pm.

On the Tuesday morning in question, Bryana telephoned Andre asking if she could pay 1.5 million dollars which Andre promptly rejected. Bryana later wrote a letter stating she accepts the offer at 1.7 million dollars as stated and delivered this letter to Andre by 3.00 pm that day.

Collin on the other hand, sent an acceptance fax message to Andre on the Tuesday morning in question at 10.00 am, but went on in the fax to ask Andre if he Collin could pay half of the 1.7 million in cheque and the other half by cash. Andre received the fax message but never replied. Collin delivered the original of the fax to Andre at 6pm on the Tuesday in question.

Andre refused to sell the vehicle to either Bryana or Collin and has instead sold it to Gretel for 2 million dollars.
