Description:

This task builds on two roleplay tasks completed in Assessment Task 2. In the previous task, you had conducted two meetings and negotiated strategic and business partnership relationships. In this task, you will be required to develop and present draft business agreements as the final step.

In Australia, contracts can be verbal (spoken), written or a combination of both. Some types of contract such as those for buying or selling real estate or finance agreements must be in writing. Written contracts may consist of a standard form agreement or a letter confirming the agreement.

Continuing in your role as the Customer Service Manager for ATDW, prepare two standard written business agreements for the purpose of presentation to the stakeholders and clients. Most of the standard contracts include common information and clauses as required under the Corporations Act 2001. However, your task will be to prepare plain language and task-specific agreements containing terms and conditions with a view that they can be inserted into legal agreement formats. You may use sample templates and structures provided in the class as guides. Your trainer/assessor will continue to play the role of your manager.

Assume that ATDW organisational requirements for such agreements include;

  1. Specific responsibilities of the parties
  2. Performance measures
  3. Provision for cancellation of the agreement
  4. Contract manager appointed from both the parties
  5. Approval by the manager

Accordingly, draft two plain English agreements as per the two negotiated scenarios in Assessment Task 2 that include;

  • Background and context
  • Purpose
  • Proposed partnership and business models
  • Key stakeholders
  • ATDW responsibilities
  • Partner/Party responsibilities
  • Fees and payments
  • Performance measures (KPIs)
  • Communication and approvals
  • Changes to the agreements
  • Cancellation of the agreements
  • You may change the contents and formats to suit two different agreement types and purposes. Fees and payments can be assumed based on the negotiations that took place in the previous task.
  • Agreement language, format, and presentation must reflect standard business practice and common templates.
  • When completed, obtain the final approval and sign-off from your manager (trainer/assessor roleplay).
