Plaintiff, Kraft Foods Holdings, Inc. (“Kraft”), is the manufacturer and distributor of Velveeta brand cheese products and has owned the Velveeta trademark since 1923. Defendant Stuart Helm calls himself “King Velveeda” and operates a website at http://www.cheesygraphics.com that contains sexually explicit photographs, drawings, and other material and provides noncheese merchandise or services for sale to the public. Mr. Helm’s website also contains illustrations of drug use and paraphernalia. One of the items Helm designed and sells on this site is a comic book called “Velveeda SINGLES and Seconds.” Helm’s website and its use of the name brought on a lawsuit from Kraft claiming Helm was tarnishing the Velveeta trademark in violation of the Lanham Act. Prepare a statement arguing that Kraft should prevail in court.
