The extent to which the agency is disclosed determines whether the agent or principal is liable for a contract created by an agent. Contracts created by disclosed agents are fully and entirely accountable to the principal. Yet, contracts created through an unreported agency puts agents totally accountable. Why would the agent's responsibility be affected by the level of disclosure?
