A worker is presumed to have an occupational disease if the worker has a prescribed disease and, on the day the worker is diagnosed with the prescribed disease, the worker meets the specific conditions prescribed by the regulations. LATMP act 30. A worker who is not presumed to have an occupational disease under section 29 is considered to have an occupational disease: (1) where the employee suffers from an illness contracted by or on the job that is not the result of an accident at work, or an injury or illness caused by such an accident. (2) when he demonstrates to the Commission that his illness is characteristic of work he has carried out or that it is directly related to the particular risks of that work.
