Marcie is a paralegal at a law firm that does PI work. She strikes up a conversation
Question:
Marcie is a paralegal at a law firm that does PI work. She strikes up a conversation at her son's soccer practice with another mother (Jean) who she has never seen before at soccer practice. She asks Jean about the cast on her arm and how she got it. Jean explains that she was in a car accident a few weeks back and was pretty badly hurt when the other driver ran a red light. She says she has been working with the other driver's insurance company but is getting pretty tired of the whole thing.
Marcie asks Jean if she has thought about suing the other driver. Jean said she hadn't.
Marcie continues: "My boss is a great attorney. He is the best PI attorney in town and has tons of experience. He just won a big settlement of $500,000 in a car accident case It was in the paper."
Jean says she isn't sure if she wants to hire an attorney and Marcie says "Well, here's a card from our firm in case you change your mind."
Do you think Marcie engaged in unlawful solicitation, lawful solicitation, or no solicitation at all?
- Did Marcie say anything wrong when she called her boss the "best in the area"?
- Did Marcie do something wrong when she told Jean about the big verdict?
- If you believe that Marcie violated the AZ rules of professional conduct solicitation rules, what do you think she should have done differently when striking up a conversation with Jean?
