Question:
Mr. Jed Law was sentenced in the County Court of Victoria to an effective aggregate term of 8 years and 6 months in relation to nine sexual offenses including incest. He was sentenced to a non-parole period of four years. Jed was sentenced in relation to offending against his grandson, then aged 8, and against his granddaughter. It was accepted he offended his grandson between 1983 and 1985 and his granddaughter between 1996 and 2000.
He was also found guilty of sexual offences against his daughter and this offending was said to have been committed from when she was aged 13 to when she was aged 18. The Sentencing Judge noted however, it was his opinion this offending may have commenced when she was aged around 7/9. It was established that Jed's duration of offending demonstrated that a pattern of child abuse had persisted for a period of some 40 years. Jed suffered from chronic obstructive airway disease and emphysema, from Type 2 insulin-dependent diabetes myelitis, hypertension, hypercholesterolemia from ischemic heart disease and stable angina. Jed's wife, Evie Law, had medical problems including a history of colon cancer and supraventricular tachycardia which is controlled with an implanted cardiac defibrillator. Jed was regarded, as a matter of law, as a serious sexual offender.
Jed received a Notice of cancellation of his resident return visa class BB Subclass 155 on character grounds under s.501 of the Migration Act 1958 today.
Jed arrived in Australia on 21/3/1968 (aged 34) in the company of his wife. Jed and his wife have four adult children, 11 grandchildren and 3 great-grandchildren, all of whom are resident in Australia. Jed has a sister and two brothers in the U.K. but they are aged and unable to offer him any support. Jed's financial circumstances are that he has limited income and would be most unlikely to be able to generate any income if he was deported back to the U.K.
Submission in relation to the Notice of Cancellation of his RRV visa.
Need to address the character test and its requirements in the context of the scenario.
