Case 1 A French businessman visited an exporting firm in China on the morning of the first day he came to China and hoped to buy some goods. The man received an oral price offer from the firm but did not give any reply. In the afternoon of the same day, the Frenchman came to the firm again and said that he would unconditionally accept the firm's offer of the morning. But the manager of the firm had learned that the international price of the goods had gone up. According to United Nations Convention, a contract was formed only if the oral offer is accepted immediately after it is made. The Chinese manager insisted that since the Frenchman did not reply or make any requests to their oral offer, there was no contract had formed.
