Pascal was hired by Koala Bear Enterprises Limited as a Marketing Manager. In this position he had responsibility for supervising and coordinating the work of the marketing department and reported to an Assistant Vice President of the Company. Two years after being hired, personality conflicts developed between Pascal and his new supervisor who, out of spite (malice) eventually made a decision to demote Pascal to Junior Marketing Supervisor. In this position Pascal would now be reporting to persons who he formerly supervised. Pascal was unhappy with this decision and left the job. He now wishes to claim damages for wrongful dismissal.
