Dr. Brown, the medical doctor who examined Crump, discovered that Crump had a sleep disorder that caused him to spontaneously fall asleep and that Crump had on several occasions fallen asleep while driving. Crump pleaded with Dr. Brown not to inform Employer of the sleep disorder. Dr. Brown agreed, and omitted this information from the physical examination form that he sent to Green Apple Transport. Dr. Brown also sent a letter to Green Apple Transport assuring them that Crump was in all respects fit for employment as a delivery van operator. Green Apple Transport then provided Driver with a daily delivery route and paid him a monthly salary. While Crump was making deliveries for Green Apple Transport, the van left the road and struck Peter Velasquez, who suffered severe injuries as a result. Velasquez filed a lawsuit for the damages as a result of the injuries sustained in the accident against Crump, Green Apple Transport, and Dr. Brown.
