CASE:

Ms. Vahi Rite was working as the Personal Financial Officer at a local branch in East Anglia of ABC Bank. Vahi's responsibilities are customer service with key performance indicators on the dollar value of investment products marketed to and purchased by the customers. Vahi's remuneration is directly and significantly affected by the level of achievement of the financial targets given to the Bank's management.

On Wednesday last, Mr John Brown, a 65-year-old retiree, visited the bank's branch to renew his maturing fixed deposits. He was attended by Vahi. In the course of renewing the fixed deposits, Vahi presented an investment product in the high risk/high return category. Vahi was motivated to close the deal for Mr John Brown in order to achieve her given targets, Mr John Brown executed the investment proposal after much coaxing from Vahi. A few days later, the bank received a letter of complaint from Mr John Brown's son alleging that the bank and its officers have not conducted themselves professionally by promoting unsuitable investment products to his father.
